These Terms of Service ("Terms") govern your access to and use of Investa-Gate (the "Service"), including the website, the application, and all related features. By creating an account or using the Service, you agree to these Terms and to our Privacy Policy and Disclaimer, which are incorporated by reference. If you do not agree, do not use the Service.
The Service provides algorithmic stock scoring and analysis for informational and educational purposes only. It is not investment, financial, legal, or tax advice, and Investa-Gate is not a registered investment adviser or broker-dealer. You are solely responsible for your own investment decisions. You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for the accuracy of the information you provide, for maintaining the confidentiality of your login credentials, and for all activity under your account. Notify us promptly of any unauthorized use.
You agree not to: (a) use the Service for any unlawful purpose; (b) scrape, resell, redistribute, or commercially exploit data or scores obtained from the Service except as expressly permitted; (c) attempt to gain unauthorized access to the Service, other accounts, or our systems; (d) interfere with or disrupt the Service; (e) reverse-engineer the scoring framework other than as permitted by law; or (f) post content that is unlawful, abusive, harassing, defamatory, fraudulent, or that infringes others' rights. We may suspend or terminate accounts that violate these Terms.
The Service may let you create a profile, post commentary, and share portfolios or other content ("User Content"). You retain ownership of your User Content, and you grant Investa-Gate a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute it as needed to operate and promote the Service. You are responsible for your User Content and represent that you have the rights to post it. We may remove any User Content, and may remove or restrict any account, at our discretion — including any content that violates these Terms.
The Service, including the scoring framework, software, design, text, and branding, is owned by Investa-Gate and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use, subject to these Terms. No other rights are granted.
The Service incorporates data from third-party providers. We do not warrant that any data, score, or analysis is accurate, complete, current, or error-free. The Service and all content are provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, Investa-Gate and its owners, operators, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or investment value, arising out of or related to your use of the Service. To the fullest extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us in the twelve months before the claim arose, or (b) US$50.
You agree to indemnify and hold harmless Investa-Gate and its owners, operators, and affiliates from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.
You may stop using the Service at any time. We may suspend or terminate your access at any time, with or without notice, including for violation of these Terms. Sections that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) survive.
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Material changes will be communicated through the Service where practicable. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of South Carolina, United States, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in South Carolina for any dispute not subject to arbitration or small-claims resolution.
